Agreement between user and Dutchwithjoyce.com

Welcome to Dutchwithjoyce.com. The Dutchwithjoyce.com website (the “Site”) is comprised of various web pages, online store and online courses, owned and managed by Joyce Diebels. These Terms set out the terms and conditions under which you may use our website and the services we offer. By accessing or using the website for our service, you agree that you have read, understood and agree to be bound by these Terms.

1. The Service and all materials contained or transferred therein, including, by way of example, text, graphics, logos and all related intellectual property rights, are the exclusive property of Joyce Diebels. Except as expressly stated herein, nothing in these Terms will be considered as a license in or under such Intellectual Property Rights and you agree not to sell, license, modify, copy, reproduce, transmit, adapt, unless authorized by Joyce Diebels.

2. To the fullest extent permitted by applicable law, Dutch with Joyce can under no circumstances be held liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data or other intangible losses arising from or relating to the use or inability to use the service. To the maximum extent permitted by applicable law, Joyce Diebels assumes no responsibility for (i) errors, errors or inaccuracies in the content; (ii) personal injury or property damage, of any nature, resulting from accessing or using our service; and (iii) any unauthorized access or use of our secure servers and / or any personal information stored therein. Changes are periodically added to the information herein. Dutch with Joyce and its suppliers may make improvement and/or changes to the site at any time. Dutch with Joyce is also not held responsible for communication not received by their students which can lead to false advise for the programmes held under Dutch with Joyce. You also acknowledge that Dutch with Joyce is not responsible for third party access to your account that results from theft or misappropriation of your account. Study Languages LLC and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

3. We reserve the right to change these terms from time to time in our sole discretion. Therefore, it is necessary to periodically review these pages. When we change the Terms in a material way, we will notify you that major changes have been made to the Terms. Your continued use of the website or our service after such changes constitutes acceptance of the new Terms. If you do not agree to the terms or future versions of the Terms, do not use or access (or continue to access) the website or service.

4. After filling in any form on the site, you agree to receive messages and promotional materials from us from time to time, by e-mail or any other contact form that you can provide us. If you do not wish to receive such promotional materials or notices, please notify us at any time or unsubscribe from the “unsubscribe” button in any e-mail we send.

Class & Return Policy

Dutch with Joyce offers live Private and Group classes via Zoom. Registering and payment for these classes mean you will agree to the terms and conditions of the classes.
1. It is the student’s responsibility to be on time for the classes. Classes will be automatically cancelled after 20 minutes if the student is a no show.
2. It is also the student’s responsibility to come prepared, do homework and improve their Dutch. Whilst the teacher will do everything in her capability to help the student, the teacher cannot be held responsible for not enough progress in the classes.
3. Private classes are invoiced per 12 weeks initially and then will automatically be renewed per 12 classes unless the student asks for monthly payments before the initial 12 classes have finished. Alternatively, monthly invoices can be sent for an extra fee. Group classes and school term classes are invoiced per set term.
4. Private classes have a cancellation period of 4 weeks. The student needs to cancel in due period and before the next invoice to avoid paying for unused classes. The private classes work like a membership. You pay your weekly fee to have one or more classes per week. If you can’t attend a class, you may reschedule this class within 2 weeks of the original date on an agreed time and day. This is seen as an extra class and doesn’t replace another class. The student may also announce a break for holidays. Holidays need to be announced at least 4 weeks in time in written communication. An exceed in holidays and breaks can lead to losing your spot.
5. Group classes cannot be rescheduled due to the other students in the program. You pay per term and agree to complete the entire term. Once you are enrolled and payment is made, it is non-refundable, as a spot has been reserved for you, preventing others from joining the group. Due to the small size of the group classes and limited availability, refunds are generally not applicable. However, Dutch with Joyce will always try to provide a solution where possible, such as offering store/online course credit valid for 12 months. In exceptional cases, a refund may be credited at the sole discretion of Dutch with Joyce.
6. For school kids, whether in private or group classes, payment is made per school term. School terms are set by Dutch with Joyce and follow the VIC and NSW school calendars, though there may be slight deviations. Once enrolled and paid, the spot is secured, and refunds will not be given due to limited availability and high demand for after-school hours. Rescheduling is generally not possible, unless another student cancels. If holidays fall during the school term, classes cannot be rescheduled or refunded.
7. The online DIY courses have a 100% return policy. However, to be eligible, the student needs to apply for the refund within two weeks of the starting date of the course. The student is not eligible when: the course hasn’t started yet, has not tried the course accordingly, the student isn’t willing to look at another solution, has withheld important information.
